Terms of Service

1. Acceptance of Terms

By accessing or using any Etherly service — including Etherly VPN, Etherly eSIM, the Etherly Reseller program, or the Etherly API (collectively, the "Services") — you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Service Description

Etherly provides the following services:

• Etherly VPN — a virtual private network service that encrypts your internet traffic, supporting VLESS+Reality and Hysteria2 protocols.
• Etherly eSIM — anonymous eSIM data plans for 120+ countries, with no personal identification required.
• Reseller Program — wholesale VPN activation code generation for resellers via dashboard and API.
• API — programmatic access for resellers to generate and manage activation codes. Documentation at docs.etherly.one.

3. Account Registration

Accounts are created using a cryptographic seed phrase. You are solely responsible for the security of your seed phrase. We cannot recover or reset your seed phrase. Loss of your seed phrase means permanent loss of access to your account and all associated services.

4. Acceptable Use

You agree not to use the Services to:

• Engage in any illegal activity under applicable law
• Distribute malware, viruses, or other harmful software
• Send spam or unsolicited communications
• Attack, disrupt, or compromise other networks or systems
• Distribute child exploitation material
• Violate the intellectual property rights of others
• Abuse the reseller API (excessive requests, scraping, or unauthorized redistribution)

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payment and Subscriptions

All payments are processed via cryptocurrency through the Heleket payment gateway. Prices are displayed in USD and converted at the current market rate at the time of payment.

VPN subscriptions

• Subscriptions begin immediately upon payment confirmation
• Subscription periods are cumulative — purchasing a new plan extends your expiry date
• Activation codes (including reseller-generated codes) grant the same subscription terms

eSIM purchases

• eSIM data plans are one-time purchases, not subscriptions
• Data plans are subject to carrier coverage and availability in the destination country
• Device must support eSIM technology

Reseller balance

• Reseller balance top-ups are processed via Heleket (minimum $10)
• Balance is deducted at wholesale rates when generating activation codes
• Generated codes are non-refundable once created

Prices are subject to change; existing subscriptions and reseller balances are honored at the purchased rate.

6. Refund Policy

We offer a 30-day money-back guarantee on VPN subscription plans. If you are unsatisfied within the first 30 days, contact us at noreply@etherly.one. eSIM data plans and reseller balance top-ups are non-refundable due to the nature of these services.

7. Reseller Terms

• Resellers receive wholesale pricing for activation code generation
• API keys must be kept confidential; you are responsible for all activity under your key
• Resellers may set their own retail prices for end users
• Etherly reserves the right to modify wholesale pricing with 30 days notice
• Reseller accounts may be suspended for abuse, fraud, or violation of these terms
• API rate limits apply as documented at docs.etherly.one

8. Promotional Codes

Etherly may issue promotional codes that provide discounts on VPN and eSIM purchases. Promotional codes cannot be applied to reseller balance top-ups or wholesale code generation. Codes are single-use unless otherwise stated and may have expiration dates.

9. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Service status is available at etherly.one/status. We are not liable for any damages resulting from service interruptions.

10. Limitation of Liability

The Services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, Etherly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

11. Modifications

We may modify these Terms at any time. Changes take effect when posted on this page. Continued use of any Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with applicable international law. Any disputes shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
